District Court Grants Interim Order for Custody of Minor
Mohsin Tayebaly & Co. represented a client before the District Court in a dispute over the custody of a minor under Section 12 of the Guardian and Wards Act, 1890 and successfully obtained an interim order for custody on behalf of its client.
It was argued that the welfare of the minor should be at the forefront of any decision pertaining to child-related disputes. The Family Court recognized that the United Nations Convention on the Rights of the Child, 1989, as ratified by The Islamic Republic of Pakistan in 1990, specifically, Articles 7 and 9, provide that every child has the right to be cared for by their parents, and the right to remain in contact with both parents in the event of separation.
