SHC settles the “honourable acquittal” issue in malicious prosecution cases
MTC successfully litigated before the Appellate Bench of the Sindh High Court which set aside concurrent dismissal orders from lower forums pertaining to a claim for damages for malicious prosecution and defamation.
The Firm’s client was aggrieved by an FIR and ensuing criminal case against him for which he was acquitted by the trial court. The Firm’s client subsequently sought damages against the complainant for loss of reputation, mental anguish and other financial losses. The learned district courts however seeing no merit to the claims of the litigant rejected the litigant’s claims.
MTC through Senior Associate Farjad Ali Khan, represented the litigant through a 2nd Appeal before the Sindh High Court and successfully managed to have the appeal allowed and the dismissal orders set aside.
