SHC Restrains FIA in Evacuee Property matter

Mohsin Tayebaly & Co. is representing its clients in a Constitutional Petition before the Honorable High Court of Sindh at Karachi, whereby through ad-interim order dated March 25, 2026, the Federal Investigation Agency was restrained from taking any coercive/adverse action against our clients.
Our clients are the owners of certain land located in Serai Quarters, Karachi. Ownership of this property traces back to previous proprietors who obtained a Provisional Transfer Order and Permanent Transfer Certificate, after which it was duly mutated in favor of their legal heirs. Our clients acquired the property through a valid Sale Deed and a renewed lease. Despite this, the Federal Investigation Agency issued a call-up notice, claiming the property to be Evacuee Trust Property and asserting the Petitioners’ occupation as illegal.
The Evacuee Trust Property Board itself had previously recognized the property as a “simple evacuee property,” and not an “Evacuee Trust Property,” in a reference filed by its Deputy Administrator—a decision that attained finality. Although the Evacuee Trust Property Board has had no connection with the property since 1994, the Federal Investigation Agency, purportedly acting under the Supreme Court Orders from 2021, initiated an inquiry against the our clients without verifying the property’s actual status.
The Sindh High Court while issuing notice to the Respondents, directed that no coercive/adverse action shall be taken against the our clients in pursuance of the call-up notice.
