Court Strikes Down Unlawful SBCA Notices: A Victory for Property Rights in Karachi

The firm successfully represented its client (Plaintiff) in a civil suit before the Court of the learned Senior Civil Judge, Karachi Malir.

Through the suit, the Plaintiff sought Declaration, Cancellation, and Permanent Injunction against illegal notices purportedly issued by the Sindh Building Control Authority, which, acting on the basis of a malicious complaint by private Defendants and without conducting any proper inquiry, unlawfully restrained the Plaintiff from proceeding with construction of the subject land on the allegation that the Plaintiff had encroached beyond the allotted area in violation of the approved layout plan.

The firm’s team successfully demonstrated before the learned Court that the impugned notices were ex facie illegal, issued without lawful authority, and in collusion with the complainant with the intent to harass and coerce the Plaintiff.

By a detailed judgment dated February 02, 2026, the learned Court decreed the suit as prayed, declaring the impugned notices/letter to be illegal, unlawful, and of no legal effect, and affirming the Plaintiff’s lawful entitlement to proceed with the project in accordance with the applicable approvals.
