SHC Suspends Eviction Notice To Tenants Of Karachi Cotton Exchange Building

Mohsin Tayebaly & Co. successfully represented the tenants of the Karachi Cotton Exchange Building obtaining a suspension order whereby the Federal Investigation Agency (FIA) and Evacuee Trust Board’s notice to evict the tenants and remove them from the Karachi Cotton Exchange Building was suspended.
The Sindh High Court in its order noted that the tenants were directed to remove their belongings and vacate the offices which amounted to summary eviction without due process of law and the sealing and eviction actions have been taken without adjudication of title, without any lawful determination and in violation of Articles 4 and 10-A of the Constitution.
The High Court while suspending the eviction notice has called comments from the advocate general and the prosecutor general regarding the sealing of the Karachi Cotton Exchange Building.
